Seniors Club Loyalty Program – Terms and Conditions

1. Program Overview

Senior Club (“Senior Club” or “Program”) is a loyalty program which is operated by The Otter Group Limited NZBN 9429046855763 (“Silky Otter Cinemas”). By enrolling and participating in the Program, you agree that you have read and understood these Terms and Conditions and are bound by them. You consent to Silky Otter Cinemas collecting, using and disclosure of your personal information in accordance with the separate Silky Otter Cinemas Privacy Policy.

Silky Otter Cinemas reserves the right to amend, alter, withdraw or terminate the Program, any feature or Benefit (“Benefits”) or the Terms and Conditions of the program at any time without notice. Any such changes may affect Benefits, which may have accumulated, as well as any future Benefits. Benefits of the Program are offered at the sole discretion of Silky Otter Cinemas.

2. Defined Terms

  • “Activation Date” means the commencement date for your Senior Club membership.
  • “Anniversary” means the date the Senior Club membership started.
  • “Benefit” means those features of the program that provide members with access to discounted movie tickets, discounts on food and drink items, which may change from time to time.
  • “The Program Points” means the Program Points awarded for eligible ticket purchases made by a Senior Club Member. 
  • “The Senior Club Program” means the loyalty program which is operated by Silky Otter Cinemas and provides benefits to its members when they visit Silky Otter Cinemas.
  • “Member, Members or Membership” means a person who holds a current and active Senior Club membership.
  • “Participating Cinemas” means a Silky Otter Cinema that offers the Senior Club Program and the associated benefits which are listed at www.silkyotter.co.nz
  • “Other Benefits” means other promotions and special Benefits which may be offered to you from time to time

3. Joining the Senior Club Loyalty Program

Customers can join the Senior Club Loyalty program by completing the signup process in cinema or online at www.silkyotter.co.nz/seniors-club 

4. Participation in the Program

Senior Club Membership (Member) and Benefits are available at www.silkyottercinemas.co.nz or at participating Silky Otter Cinemas listed on the Silky Otter Cinemas website (www.silkyottercinemas.co.nz). Silky Otter Cinemas may vary the number of locations of Silky Otter Cinemas that offer the Program (‘Participating Cinemas’) and shall notify Members of such changes via email.

A Member may not gain Benefits from activities or purchases undertaken on behalf of a business. To participate in the Program, you must have a valid e-mail address, a valid mobile phone number and be 65 years of age or older. Senior Club Memberships are valid for 12 months and are renewed annually if not cancelled.

Senior Club Memberships is not transferable nor redeemable for cash. Membership can be revoked by Silky Otter Cinemas at any time, in its sole discretion and without compensation, for any reason including but not limited to: abuse or breach of any of the Terms and Conditions of the Program, any actions deemed by Silky Otter Cinemas to be contrary to Silky Otter Cinemas, the Program or the interests of its Members or partners or in the case of fraud or misuse.

Silky Otter Cinemas assumes no liability whatsoever, including without limitation, liability for any expense, loss, cost, injury, damage, accident or any other matter or thing whatsoever, however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or damages for loss of income or profits), directly or indirectly arising out of or related to the Program or by reason of the termination of or amendment to the Program in whole or in part, the value or availability of Benefits, or the addition or deletion of Benefits, reward partners or other features with or without notice.

Neither Silky Otter Cinemas nor its respective officers, agents, employees and related bodies corporate shall be responsible for any failure of the silkyottercinemas.co.nz website or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail, online or Internet entry, technical problems, traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to any computer or property related to or resulting from participating in or downloading any material relating to the Program. Silky Otter Cinemas reserves the right, at its sole discretion, to cancel or suspend this Program should a virus, bug or any other cause beyond the reasonable control of Silky Otter Cinemas corrupt the security or proper administration of the Program.

Any attempt to deliberately damage any website or to undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, Silky Otter Cinemas reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

5. Membership Enrolment and Activation

To enrol in the Program, Members must sign up to the Senior Club Loyalty Program at a Silky Otter cinema or online.

Members must provide a valid email address and create a unique password when joining or activating their Senior Club Membership, which will be used to log into a Members online account. Members are responsible for maintaining the secrecy of their Password and can change it at any time at silkyotter.co.nz. Silky Otter Cinemas takes no responsibility for any loss arising from unauthorised use of a Member’s password or a Member’s failure to comply with these provisions. Senior Club Membership cards are not transferable and remain the property of Silky Otter Cinemas.

6. Renewing Membership

Senior Club Memberships have an annual renewal.

7. Marketing, Promotions and Personal Information

By enrolling in the Program, Members will be automatically enrolled into and consent to,  receiving marketing communications, including but not limited to, the Silky Otter Cinemas e-newsletter as well as other email and SMS communications containing session times, movie information, special offers about the Program and its rewards, services and third party partner messages.  

It is the responsibility of the member to set their own communication preferences by logging into silkyotter.co.nz and selecting what they wish to receive and not receive or by selecting to opt-out of receiving email communications by selecting unsubscribe on the email footers. Members are responsible for keeping the information in their Senior Club account up to date including by not limited to their name, e-mail address, mobile phone number and date of birth.

8. Membership Benefits

Benefits are only available at participating Silky Otter cinemas and may vary from time to time. They cannot be redeemed in conjunction with any other promotional offers including, but not limited to, promotional discounted ticket, food and drink offers. Benefits are for personal use only and cannot be assigned, traded, or otherwise transferred without the prior written consent of Silky Otter Cinemas or otherwise in accordance with the Terms and Conditions of the Program. Any assignment or transfer in violation of these rules will be void and may, at the sole discretion of Silky Otter Cinemas, result in the loss of Membership or the cancellation of the affected Benefits or Account.

Benefits available to Members as part of the program include:

  • $12 Movie Tickets: Available Monday to Friday for all movie sessions before 5pm. Maximum 2 tickets per session per day. Benefit is not available for movie sessions marked as special events. Sessions marked as special events will be at the sole discretion of Silky Otter Cinemas.
  • Discounted Concessions: Membership entitles you to receive exclusive discounts on select concession items. Silky Otter Cinemas staff at its discretion will make concession discounts available to Senior Club members. 

9. Competitions

Silky Otter Cinemas may also from time to time make available to Members promotions and competitions (collectively, “Competitions”). Where applicable, Members may enter Competitions by meeting the entry criteria specified on each Competition. We may publish names of winners of Competition prizes.

Each Competition will be subject to any individual terms and conditions specified on the Website. However, some of the standard terms and conditions are as follows:

  • Awards and prizes must be taken intact as offered and are not transferable, exchangeable or redeemable for cash;
  • If an award or prize is unavailable for any reason, we reserve the right to substitute an award or prize of equal or greater value;

Silky Otter Cinemas decision on all matters relating to a Competition will be final and not subject to challenge or review. Benefits may not be redeemed in conjunction with any other promotional offers including, but not limited to, promotional discounted ticket offers. Neither Silky Otter Cinemas nor our officers, agents, employees and related bodies corporate make any representation or warranty as to the quality, suitability or merchantability of any goods or services offered or given as awards or prizes.

10. Lost, Stolen or damaged Membership cards

Lost or stolen cards should be reported immediately by notifying the Silky Otter Cinemas team. When Silky Otter Cinemas is made aware of a lost or stolen Senior Club Membership card, it will flag the card as lost or stolen and the associated account rendered inactive.

Silky Otter Cinemas is not responsible for any activity undertaken by a third party using lost or stolen Membership details in cinema or online. Members can collect a replacement card from a Silky Otter Cinemas upon paying a $2 card replacement fee. Valid photo identification will be required before a replacement card is issued. A card replacement fee will be payable for all card replacements or card re-issue requests.

11. Privacy

Silky Otter Cinemas and its respective officers, agents, employees and related bodies corporate (collectively, “we” or “our”) are committed to protecting your privacy. We collect your personal information for the following purposes to:

  • set up and administer the Program including ongoing management of Accounts
  • process and issue Benefits;
  • allow Members to participate in promotions and competitions;
  • communicate with Members, to deliver a e-newsletters, surveys and SMS communications;
  • understand Member needs and preferences, and to provide Members with products and services that meet their needs or interests;
  • recommend our products and services, or the products and services of third parties we select that may be of interest to Members;
  • provide Members with special offers and rewards from Silky Otter Cinemas and our sponsors and reward partners;
  • facilitate or enable any corporate or commercial transaction involving Silky Otter Cinemas.

Silky Otter Cinemas will obtain consent before using personal information for a purpose that has not been specified, unless the new purpose is required by law. See the Silky Otter Cinemas Privacy Policy at silkyotter.co.nz, incorporated herein by reference, for further details. Silky Otter Cinemas may share aggregated and anonymised Member data with third parties so long as that aggregated and anonymised Member data cannot be reasonably traced back to an individual. Member information is considered a Silky Otter Cinemas asset. If our business is transferred to a new owner, Member personal information may be transferred to and considered an asset of the new owner.

12. Termination, Changes and Breach

Silky Otter Cinemas may change these Terms and Conditions, any aspect of the Program including redemption procedures or any Benefits or rewards in any respect, all without notice.

13. General

These Terms and Conditions constitute the entire agreement between you and Silky Otter Cinemas regarding your participation in the Program, your entitlement to other Benefits of the Program and supersede all previous versions. Except as expressly contained in these Terms and Conditions, there are no conditions, representations, warranties, express or implied, statutory or otherwise. When you deal with Silky Otter Cinemas or its respective officers, agents, employees and related bodies corporate over the Internet, you consent to the formation of contractual relations through electronic communications. Silky Otter Cinemas has the final authority as to the interpretation of these Terms and Conditions and as to any other questions or disputes regarding the Program.

14. Privacy and Consents

Silky Otter Cinemas will disclose personal information to 3rd parties for the following purposes:

  • To optimise the Benefits available to you under rewards Program partners; and
  • To optimise offers from rewards Program partners to purchase Silky Otter Cinemas products.

The Personal information utilised for these purposes will include First Name, Last Name, address, phone number and mobile number.

15. Changes to Terms and Conditions

Silky Otter Cinemas reserve the right to change, suspend or terminate these Terms and Conditions at any time. Where Silky Otter Cinemas changes these Terms and Conditions or any Benefits under the Program an updated copy of these Terms and Conditions will be available on the Silky Otter Cinemas website. Members should regularly check for updates to the Terms and Conditions.
